1. Parties, definitions and scope

These Driver Terms form the agreement between Find My Man and Van Ltd (FMMV) and you as the independent Driver or Driver business using the platform. A Booking is work offered through FMMV and accepted by you. Reservation Fee means the amount charged for the FMMV booking and allocation service. Balance means an amount shown as payable directly to you on a standard Booking. Advance Payment means the full move price collected by FMMV before the move where that option is offered. Held Driver Amount means the part of an Advance Payment attributable to the physical Driver service and held pending the applicable release conditions. Driver Service Start means the verified point at which the physical service starts. A Dispute Event means a genuine customer complaint, refund request, cancellation issue, payment failure, fraud concern, chargeback or chargeback risk, insurance or damage claim, evidence of non-performance or serious service failure, payout hold, administrative escalation or another material issue reasonably requiring investigation before Driver funds are released.

2. Role of FMMV and the Driver

FMMV provides a booking, administration, payment-option and allocation platform. You provide and are responsible for the physical collection, transport, loading, unloading and related removal service that you accept. FMMV is not the carrier of the Customer’s goods and does not take custody or possession of them. You must not represent that you are an employee or agent of FMMV or that FMMV is carrying the goods.

3. Independent business relationship

The parties intend that you operate as an independent self-employed business and not as an employee, worker, agent, partner or representative of FMMV. FMMV has no obligation to offer any minimum number or value of Bookings and does not guarantee earnings. You have no obligation to be available and may decline an offered Booking without that refusal alone constituting a breach. You may provide services to other platforms, businesses and customers. You are responsible for your own tax, National Insurance, VAT where applicable, business expenses and statutory obligations. Subject to the Booking requirements, applicable law and safety requirements, you remain responsible for deciding how the physical service is performed.

4. No authority to bind FMMV

You have no authority to enter into any contract, incur any liability, make any representation, provide any warranty or guarantee, settle any claim or make any admission on behalf of FMMV. Nothing in a Booking or communication creates a partnership, joint venture or agency between you and FMMV.

5. Eligibility and continuing compliance

You must remain legally entitled and suitably competent to perform every Booking you accept. You must hold and maintain every driving licence, permit, registration, operator authorisation, right-to-work requirement and other approval legally required for you, your vehicle, your personnel, the goods and the journey concerned. You must keep your profile and compliance information accurate and notify FMMV promptly of any expiry, suspension, restriction, prosecution, disqualification or other change that may affect your ability to perform work safely or lawfully.

6. Offering and accepting work

An offer of work is not binding on you until you accept it. Only accept a Booking that you can reasonably and lawfully perform with the required vehicle, equipment and personnel. Once you voluntarily accept and are allocated to a Booking, that Booking becomes binding on you and you must attend and perform it in accordance with these Driver Terms, the job sheet and any lawful Booking-specific requirements unless it is cancelled, reallocated, made unsafe or impossible, or otherwise dealt with under these Driver Terms.

7. Job sheet, customer terms and precedence

The job sheet records the Booking-specific requirements, price, payment method, locations, timing, inventory and other operational details known to FMMV. You must check it before accepting and again before attending. The Customer Terms applicable to that Booking govern the Customer relationship and may allocate responsibilities relevant to your physical service. If there is a conflict, a specific written Booking instruction issued by FMMV takes priority for that Booking, then these Driver Terms, then general dashboard or FAQ guidance. Nothing in general guidance changes an agreed Booking price or payment entitlement unless expressly stated.

8. Vehicle, licences and insurance

Your vehicle must be legal, taxed where required, roadworthy, clean, safe, properly maintained and suitable for the Booking. You must maintain motor insurance appropriate to the work you undertake, including carriage of goods for hire or reward where required, together with goods-in-transit and public-liability insurance at or above the minimum levels stated in the current FMMV compliance requirements or any higher level required by law or a particular Booking. You must provide evidence before activation and whenever requested, keep renewal evidence current and notify FMMV immediately if cover is cancelled, lapses, is restricted or becomes unsuitable. You must not accept or perform work without the legally required cover.

9. Helpers, loaders and other personnel

Where a Booking requires additional loaders or helpers, you are responsible for supplying them unless the job sheet states that the Customer is loading or FMMV has expressly arranged otherwise. Any person you engage is engaged by you, not by FMMV. You are responsible for their competence, conduct, lawful right to work, pay, tax, insurance, confidentiality, data handling, health and safety and any damage or loss they cause. Nothing creates an employment or contractual relationship between FMMV and personnel engaged by you. You must not transfer your account or an accepted Booking to an unapproved person where identity, verification, licensing or insurance requirements apply.

10. Health, safety and fitness for work

You are responsible for carrying out the physical service safely and in accordance with applicable health and safety law. This includes safe manual handling, safe loading and unloading, observing vehicle and axle load limits, securing goods, using suitable equipment, ensuring helpers are competent and stopping work where conditions create an unacceptable risk. You must not drive or work while impaired by alcohol, illegal drugs, medication or fatigue to an extent that makes the work unsafe. You may refuse or stop an unsafe instruction or unsafe part of a Booking and must notify FMMV promptly.

11. Customer conduct and care of property

Treat Customers and other people professionally and without harassment, threatening behaviour or unlawful discrimination. Take reasonable care of Customer premises and property, follow the agreed service requirements and do not remove, dispose of, use or retain property except as required to perform the Booking. If a Customer or another person is intoxicated, aggressive, abusive or creates a safety risk, you may withdraw to a safe position and must contact FMMV as soon as practicable.

12. Customer information, confidentiality and data protection

Customer names, telephone numbers, addresses, messages, access details and other Booking information are confidential and may be used only to perform, administer or evidence the Booking, comply with law or deal with a genuine claim. You must keep that information secure, prevent unauthorised access or disclosure, avoid storing it for longer than necessary and never use it for unrelated marketing. Each party must comply with applicable UK data-protection law for processing under its control. To the extent you process personal data on documented instructions from FMMV, you must process it only on those instructions, including in relation to any international transfer; ensure confidentiality and appropriate technical and organisational security; notify FMMV without undue delay of any actual or suspected personal-data breach; assist reasonably with data-subject requests, security obligations, impact assessments and regulatory enquiries; and delete or return the data when the instructed processing ends, subject to lawful retention obligations. You must ensure authorised personnel are bound by equivalent confidentiality and security duties. You must not appoint another processor for FMMV-controlled personal data without FMMV’s prior specific or general written authorisation; where general authorisation is given, you must give reasonable advance notice of a proposed change and impose equivalent data-protection obligations on the authorised sub-processor. You must make information reasonably necessary to demonstrate compliance available to FMMV and allow and contribute to reasonable audits or inspections relating to that processing, subject to proportionate notice, confidentiality and security requirements.

13. Non-circumvention and independent business

You remain free to advertise your business and obtain work independently. However, during a Booking and for 12 months after its completion or cancellation, you must not intentionally use Customer details or an introduction obtained through FMMV to solicit or accept a direct future Booking from that Customer where the purpose or effect is to avoid the FMMV platform or its booking service. This restriction does not apply to a Customer with whom you can demonstrate a genuine pre-existing business relationship before the FMMV introduction, or to work obtained independently without using FMMV Customer data.

14. Prohibited items and refusal of load

You must not knowingly carry explosives, flammable or hazardous materials, illegal goods, firearms or weapons, cash, jewellery or other unusually high-value valuables, perishables or specialist items that require handling not agreed for the Booking. You may refuse any unsafe, unlawfully carried, incorrectly declared, hazardous, excessive or materially different load. If items, weight, access or hazards have been materially misstated, contact FMMV before proceeding with material changes or additional charges.

15. Waste, recycling centres and disposal journeys

FMMV does not treat ordinary removal Bookings as regulated waste-clearance or waste-carriage work. A Customer may book transport of property to a recycling centre, household waste site or similar destination, but you remain responsible for ensuring that the carriage is lawful. Do not carry controlled or commercial waste where a waste-carrier registration, environmental permit or other authority is required unless you hold every requirement that applies and the Booking is expressly suitable for that activity. You may refuse a disposal journey where the site, load, vehicle or legal requirements are not satisfied.

16. Passengers and equipment

Only carry a Customer or other passenger where you choose to do so, the Booking permits it, the vehicle has a lawful seat and restraint, and your insurance allows it. You must provide suitable blankets, straps, securing equipment, trolleys and other equipment reasonably necessary for the work you accept and keep that equipment safe and serviceable.

17. Payment definitions and general rules

The Reservation Fee is payable to FMMV for the booking and allocation service and is not Driver revenue. On a standard Booking, the Balance shown on the job sheet is the amount ordinarily payable directly to you for the physical service, subject to the Customer Terms and any lawful adjustment. On an Advance Payment Booking, FMMV collects the full move price and holds the Held Driver Amount subject to these Driver Terms and the applicable payment workflow. You must follow the payment method shown on the job sheet, collect only sums genuinely due and never demand an amount already shown as paid to FMMV.

18. Standard-payment Bookings

Where the job sheet states that the Customer must pay a Balance directly to you, you are responsible for collecting that Balance and any properly agreed additional charges using a lawful payment method. You must not increase the booked charge merely because a Customer prefers a particular payment method. If a payment problem occurs, do not threaten or detain the Customer or their property; contact FMMV and use lawful recovery routes. Any right to suspend completion for a genuinely unpaid Balance is subject to safety, law and the Customer Terms for that Booking.

19. Advance Payments and Customer sign-off

For an Advance Payment Booking, the quoted Booking amount has already been paid to FMMV and must not be collected again from the Customer. Receipt of the Advance Payment or allocation of the Booking does not by itself make the Held Driver Amount due to you. At the end of the completed service, while you are still present, make reasonable efforts to have the Customer electronically confirm completion from the Customer receipt. Once sign-off is received and no Dispute Event or other blocking condition exists, the Held Driver Amount becomes eligible for release under the current payout timetable and is normally processed within one working day once eligible. Bank or payment-provider settlement times are outside that processing target.

20. 30-day long-stop release and Dispute Events

If Customer sign-off is not obtained, FMMV may continue requesting it. When 30 days have elapsed from the date on which completion sign-off first became available, the Held Driver Amount becomes eligible for long-stop release and FMMV will ordinarily approve it without Customer sign-off provided no Dispute Event exists. A Dispute Event pauses or prevents long-stop release while reasonably investigated. Long-stop approval records that the payment conditions were met without Customer sign-off; it does not represent that the Customer confirmed completion. A later valid refund, chargeback, fraud finding, insurance claim or other contractual right may still create a repayment obligation where these Driver Terms permit it.

21. Cancellations, no-shows and changes

Before you accept and are confirmed on a Booking, no Driver payment is due for that Booking. For a standard Reservation Fee and Balance Booking, if the Customer cancels more than 48 hours before the Move Time, no Balance is due to you unless the job sheet or a specific written agreement says otherwise; if the Customer cancels within 48 hours of the Move Time or does not attend, the remaining Balance shown for the Booking remains due directly to you under the current Customer cancellation policy, subject to applicable law, the loss adjustment below and any FMMV-confirmed adjustment. Any cancellation claim must be lawful and evidenced, must not exceed your reasonable direct loss, and must allow for costs saved, replacement income and reasonable steps to reduce loss. The Balance is a maximum, not a guaranteed payment or an automatic entitlement to the full quoted price. You are solely responsible for invoicing and collecting any lawful cancellation Balance directly from the Customer, and for deciding whether to pursue lawful recovery at your own cost and risk. FMMV does not guarantee, advance or make good an unpaid Customer Balance and has no obligation to pursue or fund recovery for you. Any administrative help FMMV chooses to provide does not transfer that responsibility or create a payment guarantee. Do not include the FMMV Reservation Fee in your claim or recover the same loss twice. This allocation does not remove any payment obligation FMMV has for funds it actually holds and which are properly due to you, or any liability that cannot lawfully be excluded. For an Advance Payment Booking cancelled before Driver Service Start, the Held Driver Amount is not automatically due to you: FMMV applies the Advance Payment cancellation and refund policy, including the applicable capped FMMV retained amount, and only a Driver amount specifically approved under that policy is payable. After Driver Service Start, payment and any refund are determined by the service actually supplied and any pre-agreed unavoidable external costs. If you cancel, fail to attend or fail to perform without a lawful or agreed reason, you are not entitled to payment for unperformed service and may be responsible for reasonable direct losses caused by your breach. Unsafe conditions, material Customer misrepresentation and force majeure are dealt with under the relevant clauses rather than automatically being treated as Driver cancellation.

22. Additional charges, access costs and ferries

Additional charges must be genuinely applicable to the Booking, proportionate, communicated clearly and, where reasonably possible, agreed with the Customer before the extra cost is incurred. They may include additional items, extended waiting, stairs, long carries, restricted access, parking, congestion or clean-air charges, road tolls and required ferry fares where the Customer Terms make those costs payable. Where a ferry is required, the Customer is responsible for the van and Driver ferry fares for every crossing required to complete the move, including the return crossing, unless the Booking expressly states otherwise. Keep reasonable evidence of external costs and do not invent or inflate charges.

23. Damage, accidents, claims and evidence

Notify FMMV promptly of any damage, loss, accident, injury or circumstance likely to give rise to a claim and, where practicable, no later than 24 hours after the Booking. Preserve relevant photographs, video, messages, receipts, job information and other evidence. Notify and cooperate with your insurer where the matter may be insured and provide policy or claim details reasonably requested by FMMV. Do not admit liability, settle a claim or make a representation on behalf of FMMV. You remain responsible for loss or damage caused by your negligence, breach, vehicle or personnel. Any Customer-facing item limits, packing exclusions or pre-existing-damage provisions applicable to the Booking operate only to the extent legally enforceable and do not reduce your obligation to maintain required insurance.

24. Disputes, fraud, chargebacks, repayment and recovery

FMMV may pause or withhold unreleased Driver funds while a Dispute Event is reasonably investigated. You must cooperate promptly and provide requested evidence. Do not seek to collect an Advance Payment amount again from the Customer while a dispute is being reviewed. If FMMV has paid you and a later refund, payment reversal or chargeback is properly attributable to your fraud, breach, non-performance, duplicate collection or another amount for which you are contractually responsible, you must repay the amount lawfully due. FMMV may set off a matured, identifiable and lawfully recoverable Driver debt against ordinary sums otherwise payable to you where permitted by law and the applicable payment policy. Unreleased Held Driver Amounts must not be used to clear unrelated historic Driver debt where the current Advance Payment policy prohibits that use.

25. Liability of FMMV to the Driver

Nothing in these Driver Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded or limited. Subject to that, FMMV is not liable for indirect or consequential loss or loss of profit, revenue, business, opportunity or anticipated savings arising from an offered or accepted Booking. FMMV does not guarantee the conduct, solvency or availability of any Customer, the availability of future work or uninterrupted operation of third-party payment, mapping, messaging or banking systems. Subject to amounts that are undisputed and properly due to you for completed eligible work, the aggregate liability of FMMV arising from a particular Booking is limited to the Driver service amount payable for that Booking, to the extent that limitation is lawful and reasonable.

26. Driver responsibility and indemnity

To the extent caused by your breach of these Driver Terms, negligence, unlawful act or omission, unsafe vehicle operation, conduct of personnel engaged by you, misuse of Customer data or failure to maintain legally required licences, registrations or insurance, you are responsible for the resulting loss. You indemnify FMMV against third-party claims, losses, damages and reasonable external costs to that same extent, except to the extent the loss was caused by the negligence, breach or unlawful act of FMMV. This clause does not require you to indemnify FMMV for losses that the law does not permit FMMV to transfer to you.

27. Force majeure and events outside reasonable control

Neither party is in breach for delay or failure caused by an event genuinely outside its reasonable control, including severe weather, road closure, major transport disruption, emergency restrictions or another comparable event, provided the affected party acts reasonably to reduce the effect and communicates promptly. This does not excuse a failure to maintain a roadworthy vehicle, required insurance, routine maintenance or sufficient personnel. Accrued payment, confidentiality, data, claim and repayment obligations are not extinguished merely because a force-majeure event occurs.

28. Restriction, suspension and termination

FMMV may restrict access to new work, suspend the account or terminate the Driver relationship for expired or invalid insurance or licensing, material safety concerns, suspected fraud, serious Customer complaints, data or confidentiality breaches, abusive conduct, unlawful activity, repeated cancellations or no-shows, material service failures or another substantial compliance or operational risk. Immediate suspension may be used while a serious issue is investigated. FMMV may require an already accepted Booking to be completed where safe and lawful or may reallocate it. Suspension or termination does not extinguish accrued payment rights, pending investigations, claims, repayment obligations, confidentiality, data obligations or provisions intended to survive termination.

29. Communications, changes and versioning

Keep your email address, mobile number and other contact details current. Operational notices may be sent through the dashboard, email, SMS or another contact method you have provided. FMMV may update these Driver Terms for future work. A material change may require you to review and accept a new version before you can view or accept new work. A non-material correction, formatting change or clarification that does not materially alter rights or obligations may be published without requiring fresh acceptance. The version recorded against your acceptance governs your relationship for Bookings to which that version applies unless a later version is validly accepted.

30. Entire agreement, assignment, severability, waiver and law

These Driver Terms, together with accepted Booking-specific terms and any document expressly incorporated into them, form the entire agreement between you and FMMV concerning work obtained through the platform. You may not assign or transfer an accepted Booking or your rights under these Driver Terms without prior written approval where that would affect identity, compliance or performance. FMMV may assign its rights and obligations as part of a lawful business transfer. If any provision is invalid or unenforceable, the remaining provisions continue in force and the affected provision is applied to the minimum extent necessary to make it valid where possible. A delay or failure to enforce a right is not a waiver. No person who is not a party has a right to enforce these Driver Terms under the Contracts (Rights of Third Parties) Act 1999. These Driver Terms and any non-contractual dispute arising from them are governed by the law of England and Wales and, subject to any mandatory rule that applies, the courts of England and Wales have jurisdiction.
